Obama’s Attack On Internet Ruled Illegal

We’re talking about Julius Genachowski, President Obama’s appointee as FCC chairman and his attempts to control the internet by way of his “net neutrality” regulations. The three Democrats on the FCC panel approved the planned changes.

But wait. According to the Washington Examiner- A federal court has ruled that the commission has no authority to regulate the Internet, and a bipartisan group of senators and representives warned Genechowski not to attempt to impose a regulatory regime on the Internet earlier this year. The move’s legality was even questioned by FCC Commissioner Michael Copp, one of the Democrats who voted today with Genachowski, saying he considered voting against the proposal because it lacks a sufficiently defensible legal basis to survive a court challenge promised by major Internet Service Providers like Verizon, Microsoft, and AT & T.

The arrogant power drunk Obama appointee Genachowski still plans to proceed with the regulation. Tea Party Senator Jim De Mint (“Put on your boxing gloves. The fight begins today.”) to the rescue. His statement on the issue-

Proceeding on its own liberal whims rather than facts, this FCC has chosen to grant itself broad authority to limit how businesses can bring the internet to consumers in faster and more innovative ways. Americans loudly demanded a more limited federal government this November, but the Obama Administration has dedicated itself to expanding centralized government planning. Today, unelected bureaucrats rammed through an internet takeover, even after Congress and courts warned them not to.

To keep the internet economy thriving, this decision must be reversed. Regulatory reform will be a top priority for Republicans in the next Congress, and I intend to prevent the FCC or any government agency from unilaterally burdening our recovering economy with baseless regulation.

In order to provide the stability businesses need to grow, I will work with my fellow senators to see passage of my FCC Act, which would ensure that the FCC can only use its rulemaking powers where there is clear evidence of a harmful market failure, as well as the REINS Act, which would add the accountability of a Congressional vote before any government agency’s proposed major regulations may be finalized.

Good for you Jim, these bureaucrats are out of control everywhere in the west and they badly need to be stopped. And once again, a Tea Party rep sticks it up the Obama administration while the rest of the Republicans stand mute. (Update- Have since read where other Republicans [John Boehner, Marsha Blackburn], are promising similar action)

    Reading a post on a net forum the other night. This guy claimed he was working with the FCC and was a technician trying to implement “net neutrality”. He claimed net neutrality meant exactly that, they do not wish to impose censorship but are trying to rein in the power of net server companies. According to this guy certain companies are slowing down web traffic, if the website getting the traffic does not advertise on. or use the web server company. Anyhow that is roughly what he said, forgive me for not posting a link can’t remember what site I was looking at, think it was at drudge. Take it as you may, think the bastards aren’t to be trusted for two seconds.

    Yeah the argument is Server Providers are slowing down the advertising videos of their competitors – amongst the other reasons you list…

    Hardly a reason to go nuclear, especially when the Court is telling you to get ****ed… Let the ISPs sue each other…
