The way I see it is that if a guy wants to kill Americans and attack the American Constitution, even if he was born in America, he has no business asking to be protected by a legal system that has that Constitution as its basis.
Ron Paul is wrong on this. Furthermore it goes further even than how Gingrich portrays it, (although I am sure he did not really mean to imply any official recognition of the guy as a soldier.)
The dead guy was not really engaging in an “act of war”. There is no official war. The guy killed was a terrorist fighting for a foreign terrorist group and therefore is operating outside the legal structure within the US.
And being a terrorist he is not even due the protection of the Geneva convention, which should only cover the armed forces who have signed up to that convention.
This guy’s only ambition was to kill Americans and engage in terror, and that he was killed by Americans before he could realise that ambition is a good thing.
Terrorists fighting on foreign soil and trying to destroy the US and its Constitution deserve only death. To say such scum deserve the protection of the Constitution is crazy.

Mark Levin has Mr. Gingrich scheduled for late in his show today, Wed, 11/16.
I’m dying to hear him ask Newt “Do you believe that CO2 is a pollutant?”
And then, should the answer be in the negative, the money question followup: “How do you plan on ending EPA’s insistence that it is?”
I asked that on my blog these be asked at Saturday’s debate, but they never were.
I asked Mr. Levin on my blog last night.
And now I’m mentioning it here, before I have a chance to get through to the show. I don’t need to be the one to get through to ask it. Any red-blooded conservative who’s frustrated by all the BS in these run-up to the GOP primaries shows can try to get Mr. Levin to put Newt on the spot. Then does Mr. Levin have the nads? Or is he really just another poseur who makes money selling books that are attractive to conservatives, but are only hollow words coming from the likes of him?
Mr. Levin is the current fire-breathing conservative talker. But he appears to be just an act with every opportunity he “somehow” misses. This line of questioning ought to come to his own mind without any prompting from me or any conservative.
And then if Newt says he’ll reign in EPA, I bet you’d like Mr. Levin to ask, “How do we know you won’t behave like Julia Gillard after you’re elected?”
